Terms and Conditions
Resilimy Facilitator Training Course (the “Course”) and the Resilient Living Programme (the “Programme”)
We are Resilimy registered in England and Wales under registration number 14526472 and registered address of 66 Brent Street, London, NW4 2ES, and we are the provider of the Course and the Programme.
Contract of Services between you and Resilimy
Please read these terms and conditions (“T&Cs”) carefully before you enrol in the Course and use the Programme. These T&Cs tell you who we are, how we will provide products to you, how you and we may enter into, change or end contracts in relation to the Course and other important information.
Accepting these T&Cs and completing your booking forms the contract between you and Resilimy for the Course and the Programme. You will receive an email to confirm your booking as well an invoice/receipt.
Course Fee
The fees payable for the Course are as per the quote above (the "Course Fee"). You must pay the Course Fee prior to commencement of the Course. If Resilimy has agreed that you may pay your course fee by instalments, you must set up the payment plan before the Course start date and you must pay the full Course Fee before the course is completed. Your place is not confirmed until the Deposit and the completed registration form is received.
Annual Licence Fee
Following completion of the Course, you will be immediately required to pay the annual licence fee of £300.00 (the "Annual Licence Fee") in order to access the Programme and supporting material and receive your course Certification. For the avoidance of doubt, you are not permitted to deliver the Programme (or any part thereof) without a Licence.
If you are currently an iheart Facilitator delivering the curriculum to young people, and are paying the curriculum license, no additional payment will required for access to the Resilient Living Programme for Adults and supporting materials, so long as you fulfil the requirements set out in this document.
Certification lasts for one year from the date of completion of the Course. In order to renew your certification, you must:
- Continue to pay the Annual Licence Fee, which is due on each anniversary of the date you completed your Course (the "Renewal Date").
- Fulfil all requirements of the Resilimy Quality Assurance & Continued Professional Development process. Further details of this process and its requirements will be provided prior to the commencement of the Course.
Resilimy retains the right to withhold the licence in situations where:
- There is a clear indication that you are not delivering the Programme for the purpose and audience for which it was intended (as set out in Paragraphs 2 and 3 of the "Use of the Programme" section of these T&Cs); or.
- You demonstrate a lack of commitment and adherence to the Resilimy core values, educational framework and core principles which underpin the Programme.
Resilimy may amend the Annual Licence Fee at its discretion and in the event that Resilimy does so, Resilimy will use reasonable endeavours to give you three (3) months’ notice of such change.
Cancellations
All cancellations must be received in writing to [email protected]. Cancellations received 28 days or more prior to the start of the Course will receive a full refund. For the avoidance of doubt, no refunds will be issued if you withdraw from the course in this 28-day period before the Course starts.
Course Transfers
You can transfer your booking to the next Course with availability provided you notify Resilimy in writing at least 28 days prior to the start of your Course. Any such transfers will be at the discretion of Resilimy.
Non-attendance at a Course
We will not issue refunds for delegates who fail to attend Courses for whatever reason.
Cancellation of a Course by iheart
Resilimy reserves the right to alter published programmes, materials, trainers, or venues for the Course without prior notice and without liability. Resilimy also reserves the right to cancel a course at any time without liability to delegates for expenses incurred.
All of our training courses are extremely practical and hands-on. We base our courses on case studies, group activities and group interaction. If we do not receive adequate numbers to ensure the training course is practical and effective for each delegate, we retain the right to cancel the course.
In such circumstances, delegates will be offered an alternative date or a full refund.
Course content
Resilimy reserves the right to change the Course content to reflect changes and updates in delivery methods and learning materials.
Attendance and course work
You are required to attend all modules of the Course and you are required to submit Course work on time as directed. Failure to comply to either of these points may result in you being unable to continue and complete the Course.
Force Majeure
If a Force Majeure Event occurs, Resilimy reserves the right to cancel, suspend or vary the operation of Resilimyobligations to you if a Force Majeure event occurs, and such cancellation, suspension or variation shall not be considered a breach of these T&Cs .
A “Force Majeure Event” may include fire, flood, storms, strikes, lock outs, riot, hostilities, acts of war, pandemics, non-availability of material or suppliers or any event outside of Resilimy control.
Warranties and Liabilities
Resilimy will deliver the Course and maintain the Programme with reasonable skill and care. Except as otherwise provided in these T&Cs, and except where goods or services are sold to a person dealing as a consumer, all warranties, representations and undertakings, whether express or implied, statutory or otherwise, including but not limited to warranties of satisfactory quality, accuracy, fitness for a particular purpose and of non-infringement of the rights of a third party, are hereby excluded to the fullest extent permitted by law. Where goods or services are sold to a person dealing as a consumer, nothing in these Terms and Conditions shall affect his or her statutory rights.
The total aggregate liability of Resilimy under or in connection with these T&Cs whether in contract, tort (including negligence), breach of statutory duty, or otherwise shall be limited to an amount equal to 100% of the sum of all fees paid by you to in accordance with these T&Cs.
Notwithstanding any provision to the contrary in these T&Cs, nothing in these T&Cs shall exclude or limit Resilimy liability for death or personal injury, for fraudulent misrepresentation or for any liability that may not be limited or excluded by law.
Governing Law
These T&Cs and any dispute, disagreement or claim arising out of or in connection with these T&Cs or their subject matter or formation (including non-contractual disputes and claims) shall be governed by and construed in accordance with the law of England and Wales.

Other Important Terms
These T&Cs and the documents referred to within it constitute the entire agreement and understanding of you and iheart and supersedes and extinguishes all previous drafts, agreements and understandings between them, whether oral or in writing, relating to its subject matter.
This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these T&Cs.
No waiver by us shall be construed as a waiver of any right for any breach of these T&Cs.
If any provision of these T&Cs shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable and shall not affect the validity and enforceability of any of the remaining T&Cs.
Photography and Video
On occasion, Resilimy takes photographs, videos and audio recordings which may be used to help promote courses and our general work (both online and in print). By booking into a Course/event, you are confirming that you are aware of this and have no objections to your image or voice appearing in any material issued by Resilimy it after the meeting. However, if for any reason you do not wish iheart to use your image or voice, please email [email protected].
Recording and photography by delegates is not permitted at any iResilimy courses or events.
Data Protection
In the course of providing the Course and the Programme, we will process your personal data. For further details on how we process your personal data, please see our privacy policy which is available on request.
Use of the Programme
- In order to access and use the Programme and associated materials you are required to pay the Annual Licence Fee.
- You may only use the Programme and all supporting and online materials for the purpose of sharing the Programme with individuals over the age of 18.
- You are permitted to deliver the Programme and supporting materials in the following way:
- To individual adults in a one-to-one coaching relationship. In this format, the Programme can be delivered online or face-to-face.
- To groups of parents. In this format, the programme can be delivered online or face-to-face.
- For the avoidance of doubt, you may not use the Programme or any part thereof to work with/teach/train anyone under the age of 18.
- If you wish to deliver to young people under the age of 18 you must complete the iheart Facilitator youth training course. Enquiries relating to this training course should be emailed to [email protected]
- As a Certified Resilimy Facilitator, you are responsible for ensuring you follow and adhere to any compliance involved in the delivery of the Programme. Resilimy is not responsible for the provision of any compliance certifications. Resilimy is also not responsible should any breach occur in the event you have not followed compliance guidelines.
- All deliveries must be documented on the IRP via the Resilimy delivery form. This information will be used to ensure you fulfil all requirements of the iheart Quality Assurance & Continued Professional Development process, and to provide Resilimy with important information on how the Programme is being delivered.
- The Prorgamme and all intellectual property rights in it are owned by Resilimy. Intellectual property rights means rights such as: copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world). We reserve all of our rights in any intellectual property in connection with these T&Cs. This means, for example, that we remain owners of such rights and we are free to use them as we see fit.
- Resilimy grants you a limited, revocable, non-exclusive, non-sublicensable, non-transferrable licence to use the Programme for the purposes set out in Paragraphs 2 and 3 of this section "Use of the Programme" (the “Programme Licence”) for so long as you pay the Annual Licence Fee.
- You may not translate the Programme or any part thereof into any language.
- Use of the Programme is subject to fulfilment all requirements of the Resilimy Quality Assurance & Continued Professional Development process. (Further details of this process and its requirements will be provided prior to the commencement of the Training Course).
- Resilimy reserves the right to discontinue use of the Prorgamme, withhold or suspend Certification and disable usage of the IRP (online resource portal) at any time if, in the opinion of the Management Team, you have violated any provision of these terms.
